Algorithmic Transparency in the Legislative Process (Senate Regulations)

What it is. Amends articles 169 and 190 and adds article 277 Bis to the Senate Regulations (Reglamento del Senado) to make transparent the use of AI in the legislative function: no significant AI intervention in the formation of a legislative product shall remain hidden from the public.

The Principles It Establishes

It subjects the use of artificial intelligence tools to ten guiding principles: legality, transparency, traceability, human supervision, explainability, personal data protection, non-discrimination, accountability, proportionality, and information security. Responsibility for actions and decisions remains with judges and public officials with judicial functions (personas juzgadoras y servidoras públicas con funciones jurisdiccionales): AI cannot substitute legal reasoning, automatically evaluate evidence, determine contested facts, or make decisions without human intervention.

Why It Matters

It is one of 14 mirror initiatives that Senator Dorantes introduced on July 8, 2026, to insert the same chapter, "On the Use of Artificial Intelligence Tools," into nearly all Mexican procedural law—from administrative contention and labor law to criminal, commercial, agrarian, and military law—plus an amendment to constitutional article 17. Together they pursue a single standard: AI as an auxiliary tool, under human supervision and without substituting the judgment of the person who judges or decides.
