Amendment to the Código Penal de Quintana Roo (Quintana Roo Penal Code) that adds Article 20 Bis as a general aggravating factor: increases sentences up to 1.5 times (by half) for ANY crime committed with the use of artificial intelligence. General aggravating factor model versus specific criminal statutes, applicable to current and future crimes. Approved in April 2024, it was challenged through an acción de inconstitucionalidad (constitutional challenge) 104/2024. The Suprema Corte de Justicia de la Nación (Mexican Supreme Court of Justice, SCJN) upheld its constitutionality on April 28, 2025, establishing the first judicial constitutional precedent on AI regulation in Mexican penal code. The SCJN (Pleno, April 28, 2025) dismissed 5-4 the constitutional challenge against Article 20 Bis; the norm survives and remains in force.
