Use of artificial intelligence in amparo proceedings: the Dorantes initiative

What it is. An initiative that amends the Ley de Amparo (Amparo Law) to add Chapter I Bis, "On the use of artificial intelligence tools," comprising articles 4 Bis, 4 Ter, 4 Quáter, and 4 Quinquies.

What it proposes

The initiative neither prohibits nor mandates: it permits the use of AI tools in amparo proceedings, but conditions that use on ten guiding principles—legality, transparency, traceability, human oversight, explainability, personal data protection, non-discrimination, accountability, proportionality, and information security.

The core principle is a clear boundary: responsibility for every action or ruling remains with the judge. AI cannot substitute for legal reasoning, automatically assess evidence, determine disputed facts, or make decisions without human intervention.

To maintain a record, it creates a certificate of artificial intelligence use—a form to be issued by the Órgano de Administración Judicial (Judicial Administration Body) within no more than 30 business days in its respective jurisdiction.

Why it matters

It is the amparo component of a package of 14 mirror initiatives presented by the same senator that day, introducing the identical chapter into most areas of Mexican procedural law—from administrative litigation and labor law to criminal, commercial, agrarian, and military law—plus a constitutional reform to Article 17.

And it does not arrive in a vacuum. In January 2026 the Poder Judicial (Judiciary) had already recognized, through jurisprudence (II.2o.C. J/1 K, registro digital/digital registry 2031639), that AI may be deployed as an auxiliary tool for calculations within amparo proceedings, always subject to human oversight and without replacing the core of judicial reasoning. The Dorantes initiative proposes to codify what the courts already validated through precedent: AI as support, never as a substitute for judicial judgment.
